How long will I have to wait to receive compensation after a Tepezza claim?

With no settlement yet reached in a Tepezza claim, we can only estimate the time it will take for any Tepezza claim to resolve. Based on previous defective drug claims, we can reasonably assume that:

• class action lawsuits may take over five years before a settlement is reached

For the time being, this is also the only open option. Individual defective drug claims are usually faster than class action lawsuits, and Tepezza claims may be resolved even faster, given the particular situation that Horizon Pharmaceutical (the manufacturer of Tepezza) is presently in.

Amgen, one of the biggest biopharmaceutical companies in the world, announced in December 2022 its intention to acquire Horizon. Since it is in the interest of shareholders at Horizon Pharmaceuticals to see the deal go through, it is expected that Horizon will try to resolve all Tepezza claims relatively quickly.

No Tepezza class action lawsuit was filed yet

The longer path to recovering compensation for Tepezza-related partial or permanent hearing loss and tinnitus damages would be a consolidated class action MDL (multidistrict litigation). In such a scenario, all filed Tepezza cases would go through a period of consolidated discovery, then go through bellwether trials (simply put, test trials that present participating parties with potential outcomes in actual trials). It is only then that settlement negotiations would start. It is a long process that may take five or more years. 

Is there, however, any real chance for a class action lawsuit? As of now, we cannot give a specific answer to this question. In January 2023, at least ten plaintiffs petitioned the Judicial Panel on Multidistrict Litigation in the U.S. District Court for the Northern District of Illinois, calling for consolidating all Tepezza lawsuits. However, the process is still in the preliminary stages, with no certain outcome.
